404 Permit - Compensatory Mitigation Program

For those that may require a permit for discharge of dredged or fill material into a water of the United States, this seminar will provide an overview of the U.S. Army Corps of Engineers' (USACE) process for whether compensatory mitigation is required, appropriate avoidance and minimization measures to potentially reduce the need for compensatory mitigation, and the process for determining the amount of compensatory mitigation that may be required under a project 404 permit.

 

USACE Sacramento District staff will be presenting their thoughts on selected Central Valley specific examples. Additionally, Central Valley Regional Water Quality Control Board staff will also be presenting an overview of the State's requirements for mitigation and any processes outside of a Clean Water Act 404 permit/401 water quality certification process (e.g. Porter Cologne Act) that may be required by the State.

 

Specific topics areas of discussion include:

  • The various types of mitigation (permittee-responsible, in-lieu fee, etc.)
  • How to determine the extent and amount of compensatory mitigation required based on functions and values of impacted resources
  • What kinds of resources are appropriate for use as mitigation and what monitoring may be required for created wetlands
  • How to satisfy both the State and Federal requirements in the most efficient and expeditious way possible.
  • Financial assurances and legal protections that may be required for mitigation sites
